The Will of Robert McElravey (1807-1859)


I Robert McElravey of the County of Tuscarawas and State of Ohio do make and publish this my last will and testament in manner and form following that is to say:

1st. It is my will that all my just debts and funeral expences be fully paid.
Second I give devise and bequeath to my beloved wife Hariet McElravey in lieu of her dower the plantation on which we now reside situate in Union Township Tuscarawas County State of Ohio containing forty one acres during her natural life and two head of horses that she sees proper to take with all the harness and farming impliments belonging to me also three milch cows two heifers or stears for to make her beef and all the hogs on hands all the bees also all the household and kitchen furniture and my buggy with its harness also five hundred dollars in money to be made out of the the chattels that will be solde and all the grain on hands with all other provisions and also twenty dollars per year for five years out of the rents of the Armstrong farm and hay sufficient to keep her stock through the winter.
Third I give and devise to Joseph Harvy Fenner the mare we call Lucy with my saddle and bridle and two hundred dollars. The money to be paid when the Armstrong farm is solde if he stays and farms for my wife untill he is of age if not then he gets nothing except the mare saddle and bridle.
Fourth I give and devise to Robert McElravey son of my brother Hugh the farm on which I now reside at the death of my wife and he will pay Robert McElravey son of my brother Daniel two hundred dollars at the death of my wife.
Fifth it is my will that at the expiration of five years from my death the Armstrong farm be solde and after all expences is paid of the sale of said farm and what debts remain otherwise unpaid be paid then all the residue of the price of said farm and all other unexpended assets of my estate be equally divided between the following persons to wit: my brother Hugh McElravey, my brother Daniel McElravey, my sister Nancy Hill, my nephew Dr. Hugh McElravey, my wife's sister Elizabeth Crossen, and my niece Elizabeth LaPort.
And lastly I do hereby nominate Harriet McElravey and James Edie my Executrix and Executor of this my last will and testament and hereby authorise and empower them to compromise, adjust, releas and discharge in such manner as they may deem proper the debts and claims due me. And I do authorize and empower them to sell by private sale the Armstrong farm upon such terms of credit or otherwise as they may think proper not to exceed five years from the time this is proven or sooner if they think best and make deed to purchaser to execute acknowledge and deliver in fee simple the same as if it was I myself.
In testimony whereof I have hereunto set my hand and seal this twenty ninth day of December in the year of our Lord one thousand eight hundred and fifty eight.
